The Brevard County, Florida sheriff has jumped into a legal battle between the clerk of courts and county commission.
Lawyers representing Brevard County Sheriff Wayne Ivey and the sheriff’s office filed a motion to intervene in a lawsuit filed by Clerk of Courts Scott Ellis against the county board. Ellis claims the commission is incorrectly trying to alter its cap on property taxes in order to generate more money for the sheriff.
Ellis asked for a declaratory judgment on the commission’s 4-1 decision in July to declare a critical need for additional funding for the sheriff’s office.

That would allow the county to get around a property tax cap enacted in 2008. Ivey said he needs additional funds to provide beefed-up school security, hire and retain deputies, meet equipment needs, and deal with population increases.
The commission estimated the outside lawyers for the sheriff and clerk of courts could cost $150,000.
